CVS Digital Privacy Class Action Settlement
What Is the CVS Digital Privacy Settlement About?
The case concerns information allegedly shared with Criteo and other technology providers through technology embedded in CVS digital properties. Those properties include CVS.com, CVSHealth.com and the CVS app. The information at issue includes health or private information, identifiers and browsing activity.
The parties settled to avoid the expense and uncertainty of continued litigation. The court has not determined that either company violated the law. This settlement concerns digital activity; a purchase at a CVS store alone does not establish eligibility.
How Much Is the CVS Settlement Payout?
You can select one of two benefits:
- Cash Payment A: up to $10 with reasonable documentation showing that you used a covered CVS digital property during the qualifying period.
- Cash Payment B: up to $5 without supporting documentation.
These alternatives cannot be combined. Only one claim and one cash payment are allowed per household, defined as people sharing the same mailing address. Both payment amounts may be reduced proportionally if valid claims exceed the money available.
The $20.5 million maximum also covers administration, court-approved attorneys’ fees and costs, and service awards. It is not all reserved for consumer payments. Online claimants may select PayPal, Venmo, Zelle or a check. Paper claims provide payment by check. Distribution follows final approval and resolution of appeals; the notice describes a 120-day post-approval timetable. Checks expire 180 days after issuance.
Am I Eligible to File a Claim?
The notice defines the class as living individuals who accessed CVS digital properties in the United States before July 27, 2026. There is no stated purchase requirement or starting date in that definition.
The claim form additionally asks you to certify that you were a U.S. resident when you accessed the property. If you cannot make that certification, ask the administrator to clarify your eligibility before submitting.
For the documented option, useful evidence can include dated browser history, screenshots or email receipts for online purchases. The records must show your own qualifying interaction. A personal declaration alone does not replace supporting records for the $10 option, although it may explain other documents.
Is the CVS Digital Privacy Settlement Legit?
Yes. The court-authorized notice identifies Brewer et al. v. CVS Pharmacy, Inc. and Criteo Corp., pending in the Circuit Court for the 17th Judicial Circuit in Broward County, Florida. Simpluris administers the settlement.
The final approval hearing is scheduled for December 1, 2026. That hearing is separate from the claim deadline, and payment is not guaranteed on the hearing date. Use the official settlement website to read the notice, agreement and filing instructions or contact Simpluris for assistance.
When’s the Claim Deadline?
Submit an online claim by 11:59 p.m. Eastern Standard Time on November 16, 2026, or mail a signed paper form postmarked by that date.
The separate exclusion and objection deadlines are November 1, 2026. Remaining in the settlement without filing a valid claim does not produce a payment. Unless you exclude yourself, the settlement’s release applies if it becomes final, whether or not you claim.
Who Qualifies for the CVS Settlement?
Eligibility turns on covered digital access, not whether you received a notice or still have a CVS account. You must truthfully satisfy the claim form’s certifications and must not have excluded yourself.
Multiple visits, purchases or CVS accounts do not create multiple payments. Coordinate with other people at your address so your household files only one claim. For the undocumented option, you still need to meet the eligibility requirements even though you do not submit records.
How Do I File a CVS Settlement Claim Form?
Go to the official settlement website and select the claim option. An open claim form is available for people without notice login details. Enter your contact information, select either the documented or undocumented payment, and upload your evidence if requesting up to $10.
Choose an available payment method, review the certifications and sign the form. The form also asks you to affirm that you have read and agree to the disclosures in the CVS Health Privacy Center. Keep your submission confirmation and promptly answer any administrator request to correct an incomplete claim.
Alternatively, download the paper claim form, attach any required records, sign and mail it to CVS Digital Privacy Settlement, P.O. Box 1110, Costa Mesa, CA 92628. The paper form accepts a Login ID if known. Notify Simpluris if your mailing address or other contact details change.
